Is Shawn Rhoden Innocent?
A lot has surfaced since the accusations on Shawn Rhoden were first made known to the public. See below for the official court documents available for public view describing the charges and details of the alleged incident.
Everything that has been made public so far is seemingly very one sided in favor of the accuser. Although the evidence seems to be stacked against him, Rhoden is innocent until proven guilty in a court of law. Under this protection, the prosecution has the obligation to prove each element of a crime beyond a reasonable doubt. That being said, as people start digging to see where the accusations are coming from, they’re coming across some interesting findings that are beginning to cast some doubt on the accuser’s credibility. The court of public opinion may begin siding with Shawn or at least start questioning the accuser’s allegations.
L.K.H, the accuser as she’s named in the court documents, apparently stands for Laurie Krechelle Hymas. According to mylife.com, some of the alias or nicknames that L.K.H. has used are Laurie Henderson, Krechelle Hymas, Laurie K Henderson, Laurie Hymas and Laurie K Hymas
In cases investigated by the F.B.I. and Internal Revenue Service-Criminal Investigation, with assistance provided by the Office of the United States Trustee and the Idaho Department of Insurance, L.K.H and her husband were sentenced and jailed on charges of wire fraud, bank fraud and making false statements in May of 2011.
“U.S. District Judge Edward J. Lodge sentenced Shane Hymas to five months in prison followed by three years of supervised release. Laurie Hymas was sentenced to one month in prison and will also serve three years of supervision. While on supervised release they will each be required to serve five months of home detention and perform 100 hours of community service.”
As the news of the identity of L.K.H and her shady past is being made public, what is also coming to light is that Shawn Rhoden has apparently taken 2 different types of lie detector tests and past both. See below for the video from Ron Harris.
This is great news for Shawn, but the test results are usually never admissiblein court due to the fact that polygraph tests can and have been manipulated in the past by both the person administering the test and the person being questioned to induce a false positive or false negative. But, as in the state of Utah, if both parties agree (which is highly unlikely) to allow the results as evidence, then the court may take the test results into consideration.
At the end of the day, what matters in this case is not public opinion or what L.K.H. did in her past, but instead what is in the court documents and the findings associated during discovery. It’s going to be interesting to see what Shawn has to say on the matter and how he pleads.
